Terms of Use - Warwick Punjabi Society

1. Acceptance of Terms

By accessing or using www.warwickpsoc.co.uk (the "Site"), you agree to these Terms of Use. If you do not agree, please do not use the Site.

2. Who Runs This Site

The Site is operated by Warwick Punjabi Society ("the Society", "we", "us"), an independent student society. The Site runs on a platform designed, hosted, and maintained by the Platform, operated by Deevan Parmar and Jayden Patel (the "Platform Provider").

Your relationship for memberships, tickets, events, and content on this Site is with the Society. The Platform Provider supplies the underlying technology and processes your data on the Society's behalf, as described in our Privacy Policy.

3. Eligibility

You must be 16 or older to use this Site. If you are under 18, you confirm you have parental or guardian permission to use it.

4. Accounts

  • You are responsible for keeping your login credentials confidential.
  • Activity under your account is your responsibility. Tell us promptly at warwickpsoc@gmail.com if you believe your account has been compromised.
  • Information you provide must be accurate and kept up to date.

5. Memberships, Tickets, and Payments

  • Memberships and tickets are offered by the Society and are non-transferable, unless the Society states otherwise for a specific event.
  • Payments for memberships and tickets sold through this Site are processed securely by Stripe. Card details are handled by Stripe, not stored on this Site.
  • Refunds and cancellations are handled by the Society directly, through its own Stripe account, according to the refund policy the Society states for each event or membership at the point of sale. This does not affect your statutory rights as a consumer, which cannot be excluded.
  • The Society may cancel or refuse memberships or tickets in accordance with its own rules.

Events ticketed through third parties. Some events listed on this Site are ticketed by an external provider rather than sold through this Site. For those events, the "Get tickets" button takes you to the third party's own website, and:

  • your purchase is made from that third party (or the event organiser it acts for), not from the Society through this Site; the third party's own terms of sale, prices, fees, and refund policy apply to it;
  • no payment is taken through this Site, and this Site passes none of your information to the third party. The Society may separately receive information about you from the provider (for example an attendee list for its own event) under the Society's direct arrangement with that provider, but that happens outside this Site, and neither the payment nor that information passes through the Platform Provider;
  • membership discounts and member-only restrictions on this Site do not apply to third-party-ticketed events unless the third party applies them itself; and
  • the Society and the Platform Provider are not responsible for the third party's website or its handling of your purchase. Issues should be raised with the third party directly, though the Society is happy to point you in the right direction.

6. Prohibited Conduct

You must not: attempt to gain unauthorised access to the Site, other users' accounts, or other societies' data on the platform; interfere with the Site's operation or security; scrape or bulk-extract data; upload malicious code; harass or abuse others; or use the Site for any unlawful purpose. Breach of this section may result in suspension or termination of your account and, where appropriate, referral to authorities.

7. Intellectual Property

  • The Site's underlying software, design system, and platform templates are owned by the Platform Provider.
  • Society content (including the Society's name, logo, event descriptions, and images) is owned by the Society or its licensors.
  • You may not reproduce, copy, or exploit any of the above without permission from the relevant owner.

8. Privacy

Our collection and use of your personal information is described in our Privacy Policy. The Society is the data controller; the Platform Provider processes data on the Society's behalf.

9. Availability and Liability

  • The Site is provided "as is" and "as available". Neither the Society nor the Platform Provider guarantees uninterrupted or error-free operation.
  • Nothing in these Terms excludes liability for fraud, for death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded, and nothing affects your statutory rights as a consumer.
  • Subject to the above, neither the Society nor the Platform Provider is liable for indirect or consequential losses arising from your use of the Site.
  • The Platform Provider may rely on and enforce the protections given to it in this section and section 7 under the Contracts (Rights of Third Parties) Act 1999. Otherwise, no third party has rights under these Terms.

10. Termination

We may suspend or terminate your account for breach of these Terms or misconduct in connection with the Society, in line with the Society's rules.

11. Changes to These Terms

We may update these Terms from time to time, for example when the Site gains new features or the law changes. If we make a material change, we will tell you when you next use the Site and ask you to accept the updated Terms before you make any new purchase. Changes do not affect purchases you have already made, which remain governed by the terms in force at the time of purchase. If you do not wish to accept updated Terms, you can stop using the Site and contact us about your membership.

12. Governing Law

These Terms are governed by the laws of England and Wales, and disputes are subject to the jurisdiction of the courts of England and Wales.
